Booking Terms
These Terms govern the supply of HGV, HIAB / lorry loader and related driver-hire services by JS HIAB Services (“the Supplier”) to any client or hirer (“the Hirer”). By confirming a booking, the Hirer agrees to be bound by these Terms in full.
1. Definitions
- Supplier — JS HIAB Services.
- Hirer / Client — the business or individual booking driver services.
- Driver — the operative supplied by the Supplier to carry out an Assignment.
- Assignment — the period of work the Driver is booked to perform.
2. Contract Formation
A binding contract is formed when the Supplier confirms a booking in writing (email or messaging platform). Verbal enquiries do not constitute a confirmed booking.
3. Scope of Supply
The Supplier provides qualified Drivers for: HGV Class 1 and Class 2, HIAB / lorry loader, low loader, curtain-sider, box and tail-lift, FRC, ADR and tramping work. The Driver operates under the day-to-day direction of the Hirer for the duration of the Assignment.
4. Hirer’s Obligations
- Provide a roadworthy, taxed, insured and MOT-valid vehicle. Vehicle dashboard must be free from any serious defect warnings. No active warning messages relating to the brake system, steering, suspension, air system, or other safety-critical components may be displayed
- Hold appropriate motor and goods-in-transit insurance covering the Driver.
- Provide a site induction, PPE and a safe place of work.
- Comply with EC Regulation 561/2006 (drivers’ hours) and tachograph law.
4.1 Site Induction, Licences and Accreditations
Where any site-specific licence, accreditation, induction, familiarisation, or other legal or operational requirement is necessary for JS Hiab Services to operate the Client’s vehicles, equipment, and such requirement is not already in place, the Client shall provide the necessary training, induction, at its premises prior to the commencement of the contract or driver assignment. JS Hiab Services will provide availability at a mutually agreed time to complete any required inductions, assessments, or accreditations to ensure compliance with the Client’s operational procedures and all applicable legal requirements before the start of any contract, temporary assignment, or daily driver hire. - 50% deposit is payable upfront to confirm the booking.
- The remaining 50% is payable upon completion of the shift or contract.
- In the unlikely event the Supplier cannot cover the booking, the 50% deposit will be refunded in full.
- A fixed compensation charge of £50.00 per overdue invoice, payable in addition to the invoice value.
- Statutory interest at 8% above the Bank of England base rate, under the Late Payment of Commercial Debts (Interest) Act 1998.
- Reasonable costs of debt recovery.
4.2 Agency Non-Exclusivity and Freedom to Contract
JS Hiab Services provides its services on a non-exclusive basis. Upon completion or termination of any assignment, whether lasting one day, one week, twelve weeks, or any other duration, neither the Agency nor the Client shall have any exclusive rights over the future provision of services by JS Hiab Services. Unless expressly agreed in writing by all parties before the commencement of the assignment, no introduction fee, transfer fee, restrictive covenant, restraint of trade, or similar provision shall prevent JS Hiab Services from accepting future work directly from the Client or through any other agency following the completion of an assignment. The Agency acknowledges that it has no proprietary, financial, or contractual interest in the ongoing commercial relationship between JS Hiab Services and the Client after the assignment has ended. Where vehicle hire is provided, vehicles may be based and stored at the customer’s operating premises for the duration of the contract. Maintenance and repair responsibilities remain with the vehicle supplier in accordance with the relevant hire agreement.
To provide a seamless service, vehicles supplied under contract may be presented in JS livery for the duration of the agreement. However, where separate contractual arrangements are in place, vehicles may operate without JS livery and may be presented in the customer’s branding or remain unbranded, subject to agreement.
Operations are conducted from the customer’s site where appropriate, helping to maximise efficiency and minimise unnecessary vehicle movements.
Where required, the customer may need to have sufficient authorised vehicle capacity available on their Operator’s Licence to accommodate the additional vehicle(s). All operations remain subject to applicable operator licensing, transport, and road traffic legislation. Customers are responsible for ensuring that the necessary permissions, authorisations, and operating arrangements are in place for the duration of the contract.
5. Charges
Charges are quoted per shift (minimum 8 hours) or per hour. Overtime, night, weekend and bank holiday rates apply at the Supplier’s published rates. Travel, tolls, congestion and ULEZ charges are rechargeable. All rates are exclusive of VAT.
6. Payment Terms
6.1 vehicle hire
For all bookings requiring vehicle hire from JS Hiab Services, the Client shall pay a 50% non-refundable deposit upon confirmation of the booking. The booking will not be confirmed until the deposit has been received. The deposit secures the vehicle, driver, and the agreed hire period, and contributes towards the contract value for the time the vehicle is reserved and unavailable for other work. The remaining balance shall be payable in accordance with the agreed payment terms or prior to the commencement of the hire, unless otherwise agreed in writing. :
6.2 Account Holders & Ad Hoc clients with use of Company vehicle
Where the Client has an approved credit account with JS Hiab Services and the services are provided using the Client’s own vehicle, no deposit is required. An invoice will be issued upon completion of the contract, and payment must be made by BACS within 7 days of the invoice date using the bank details provided on the invoice.
6.3 Late Payment & Compensation
Where any invoice is not paid within the agreed contractual payment terms, the Supplier reserves the right to charge:

8. Cancellation / Replacement by the Supplier
The Supplier will use reasonable endeavours to fulfil every confirmed booking or to provide a suitable replacement Driver. If unable to do so, liability is limited to refund of any deposit paid for that Assignment.
9. Transfer & Temp-to-Perm Fees
If the Hirer engages a Driver introduced by the Supplier — directly or via a third party — within 6 weeks of the last Assignment, a transfer fee of 15% of the Driver’s first-year gross salary is payable.
10. Damage, Loss & Insurance
The Hirer shall be responsible for any loss of or damage to vehicles, loads, equipment, or third-party property occurring during an Assignment, except where such loss or damage is directly attributable to the Driver’s gross negligence or wilful misconduct.
11. Health & Safety
The Hirer accepts the duties of an employer under the Health and Safety at Work etc. Act 1974 and RIDDOR for the duration of the Assignment.
12. Conduct & Removal
If the Hirer reasonably considers the Driver unsuitable, the Supplier will replace the Driver where possible. Charges remain payable for time worked.
13. Confidentiality & Data Protection
Both parties will keep confidential information confidential and comply with the UK GDPR and Data Protection Act 2018.
14. Limitation of Liability
Save for death, personal injury or fraud, the Supplier’s total liability under any Assignment is limited to the charges payable for that Assignment.
15. Force Majeure
Neither party is liable for failure to perform caused by events beyond reasonable control, including severe weather, industrial action, fuel shortages or government restrictions.
16. Governing Law
These Terms are governed by the laws of England and Wales and subject to the exclusive jurisdiction of its courts.
